What Does A Law Guardian Do In A Brooklyn Divorce?

Law Guardians are appointed during Brooklyn divorces where custody matters are in dispute.

The Law Guardian is typically an attorney whose job is to represent the child in question.

Not all cases include a Law Guardian, but if the judge has concerns that the child’s voice isn’t being heard in the heat of the divorce, a Law Guardian may step in to interview the child, his or her teachers and other caregivers, and both of the parents.

Law Guardians have the right to call witnesses during the trial phase, and can cross examine and otherwise provide evidence to the court on behalf of the child.

Their role is strictly intended to serve the best interests of the child so the court can fully evaluate the competing custody proposals.
