No, you don’t. Divorce is handled by the Supreme Court of the State of New York, and these issues will have to be addressed, at least in the near term, as part of your divorce decree.

The court won’t grant your divorce until you and your spouse have made a plan for these issues, or the court itself has made rulings on them. In the future, if you or your spouse needs to renegotiate these issues, that’s when they will be heard in Family Court.
