What Is Pendente Lite Support?

A pendente lite order is a way for the courts to establish support for the lower income spouse in a divorce before the legal process is completed.

If you are the lower earning party in a divorce, one of the first actions our lawyers take is to ask the court for a pendente lite order, which will require your spouse to provide temporary support to you and your children.

In some situations, your earning status may not be the deciding factor in pendente support.

If your spouse has moved out of the house, the court can order that they continue to pay a portion of the mortgage while the final disposition of the residence is decided in the divorce proceedings.
